This Influencer / Affiliate Policy (“Policy”) governs all collaborations, partnerships, promotions, referrals, live selling, affiliate marketing, and influencer-led activities conducted on behalf of or in association with Yooneck Fashion LLP (“Yooneck”, “Company”, “we”, “us”, “our”). By participating in any influencer or affiliate program, the influencer, affiliate, creator, or promoter (“You”, “Partner”) expressly, knowingly, and unconditionally agrees to be bound by this Policy.

1. Scope & Applicability

1.1 This Policy applies to all influencers, affiliates, creators, brand partners, live sellers, referral partners, and promoters engaged with Yooneck across digital, social, offline, or hybrid platforms.

1.2 Participation may be through formal agreement, campaign invitation, referral link, coupon code, live selling access, or any other mechanism authorized by Yooneck.

1.3 No partnership, agency, employment, or joint venture relationship is created unless expressly stated in writing by Yooneck.

2. Eligibility & Approval

2.1 Participation is subject to Yooneck’s prior approval.

2.2 Yooneck reserves the right to accept, reject, suspend, or terminate any influencer or affiliate without providing reasons.

2.3 Submission of profile, content, or application does not guarantee approval.

3. Content Guidelines & Brand Representation

3.1 All content created or shared in connection with Yooneck must be truthful, accurate, and non-misleading.

3.2 Influencers and affiliates shall not make false claims regarding pricing, discounts, availability, delivery timelines, refunds, returns, or guarantees.

3.3 Content must align with Yooneck’s brand values and shall not be offensive, defamatory, illegal, or misleading.

3.4 Yooneck reserves the right to demand modification or removal of any content at any time.

4. Disclosure & Legal Compliance

4.1 Influencers and affiliates must clearly disclose their association with Yooneck in accordance with applicable advertising and consumer protection laws.

4.2 Failure to provide proper disclosure shall be treated as a material breach of this Policy.

5. Usage of Brand Assets

5.1 Yooneck may permit limited use of its trademarks, logos, images, videos, and brand assets strictly for approved promotional purposes.

5.2 Unauthorized, altered, or misleading use of brand assets is strictly prohibited.

5.3 All intellectual property rights remain exclusively with Yooneck.

6. Live Selling & Platform Access

6.1 Influencer-led live selling, if permitted, shall be conducted strictly as per Yooneck’s platform rules and technical limitations.

6.2 Influencers shall not represent themselves as employees or official spokespersons of Yooneck.

6.3 Yooneck is not responsible for technical failures, platform issues, or third-party service disruptions during live sessions.

7. Affiliate Links, Coupons & Tracking

7.1 Affiliates may be assigned unique referral links or coupon codes.

7.2 Commissions are calculated solely based on Yooneck’s internal tracking systems.

7.3 Yooneck’s records shall be final and binding for commission calculation.

7.4 Self-referrals, fake transactions, or manipulation of tracking systems are strictly prohibited.

8. Payments & Commissions

8.1 Commission rates, payment terms, and settlement cycles shall be communicated separately and may vary by campaign.

8.2 Payments are processed only after successful order completion and applicable return or cancellation windows.

8.3 Yooneck reserves the right to withhold or reverse commissions in case of fraud, policy violations, or order reversals.

9. Prohibited Activities

9.1 Influencers and affiliates shall not:

  Misrepresent Yooneck or its products

  Engage in spam, fake reviews, or misleading promotions
  
• 
  Use Yooneck’s brand name for unauthorized ads or bidding
  
• 
  Violate any applicable law or platform policy
  

9.2 Any prohibited activity shall result in immediate termination.

10. Termination & Suspension

10.1 Yooneck may suspend or terminate participation at any time without prior notice.

10.2 Upon termination, all rights to use Yooneck’s brand assets shall immediately cease.

10.3 Outstanding commissions, if any, may be forfeited in case of breach.

11. Indemnity & Liability

11.1 Influencers and affiliates agree to indemnify and hold Yooneck harmless from any claims, losses, damages, or legal actions arising from their content or conduct.

11.2 Yooneck shall not be liable for indirect, incidental, or consequential damages.

12. Confidentiality

12.1 Any non-public information shared by Yooneck shall be treated as confidential.

12.2 Confidential information shall not be disclosed without prior written consent.

13. Governing Law & Jurisdiction

This Policy shall be governed and interpreted in accordance with the laws of India.

Jurisdiction shall lie exclusively with courts located within India.

14. Final Authority

Yooneck reserves the sole and final authority to interpret, enforce, and amend this Policy.

All decisions taken under this Policy shall be final and binding.
